An exemption is required if the prohibitions of a nature conservation area ordinance, in particular

  • to erect structures
  • to remove plants or components
  • disturbing, taking or killing wild animals
  • to camp
  • making fires
  • to hold fun runs, fun marches or similar organized events
  • make noise or use sound transmission or reproduction devices
  • to leave marked paths
  • to store items on the site

An exemption can be granted in individual cases in accordance with Art. 56 BayNatSchG, § 67 BNatSchG if

  • the prohibition would lead to an unreasonable burden in the individual case and the exemption is compatible with the interests of nature conservation and landscape management.

You submit your application in an informal letter to the responsible government. As a rule, the government in whose area the nature reserve is located is responsible for granting the exemption.

As a rule, the lower nature conservation authorities at the district administrations or independent cities are responsible for exemptions from the prohibitions of other protection ordinances, in particular for landscape conservation areas, natural monuments and protected landscape features.
