Film and television recordings of state-owned buildings and facilities as well as photographic recordings require permission. Exceptions to this are recordings of buildings and facilities located on public roads, paths or squares (Section 59 of the Copyright Act) and recordings for private purposes on a small scale.

Permission may not be granted if the recordings would endanger state property, impair official interests or cause an unacceptable hindrance to general visitor traffic. Compensation for use shall also be waived for the following recordings:

  • recordings that serve as appropriate advertising for the Free State of Bavaria or for state institutions.

When deciding which fee is appropriate, the licensing authority must take into account the extent of the use and the extent of the resulting complications as well as the historical and artistic value of the objects photographed.

Reimbursement of costs

Reimbursement of costs is charged for all expenses and loss of income caused by the recording. This includes, in particular, the management costs (electricity consumption, heating, cleaning), insofar as they are not paid directly by the sponsor of the admissions, the reimbursement of expenses for employees who supervise, advise and instruct the admission staff (wages, salaries, etc.) as well as the reimbursement of any loss of admission fees and the like. Only minor costs may be waived if they are likely to be manifestly disproportionate to the administrative effort required to determine them.
