The Bavarian Forest Rights Act (FoRG) primarily deals with so-called forest rights. These include the rights of use of third parties (forest grazing rights, timber use rights, litter rights, etc.), which are generally rooted in civil law, as well as the rights in rem to graze on non-forested land in the high mountains and their foothills.
The Forest Rights Office, based at the Government of Upper Bavaria, is responsible throughout Bavaria for applications for decisions on the regulation (fixed measurement, restriction, conversion) and replacement of forest rights and their implementation, on disputes in the exercise of forest rights and compensation payments and on other matters assigned to it by the Forest Rights Act. As a rule, the Forest Rights Office decides on the basis of an oral hearing in the composition of a chairperson and two appointed assessors (one each from the group of obligated parties and entitled parties).
As a rule, the costs of the proceedings before the Forestry Commission are to be borne by the applicant.
The amount of the fee is determined within the range of EUR 5 to 25,000 (Art. 6 para. 1 sentence 3 of the Costs Act) according to the administrative effort and the importance of the matter for the parties involved (Art. 6 para. 2 sentence 1 of the Costs Act) and can therefore only be quantified in more detail in the specific individual case. The expenses are calculated in accordance with Art. 10 of the Costs Act.
