Short-term mobility as part of an intra-company transfer; notification of the stay by the host company

If you have a residence permit from a member state of the European Union (EU) for the purpose of intra-corporate transfer, you can use it to enter Germany for a certain period of time and work there.

Procedure details

If you are not a national of an EU member state, you do not necessarily need a German residence permit to work here.

As part of EU mobility, you can enter Germany with a residence permit from an EU member state for the purpose of intra-corporate transfer and work for a certain period of time. You do not need another residence permit for this. Exception: Ireland and Denmark

You will receive the residence permit in the form of an ICT card (intro-corporate transfer). The ICT card is issued to you by the country in which you spend most of your transfer period. With the ICT card issued to you by another EU member state, you can work in a German branch of your company. You can work in Germany for a period of 180 days up to 90 days.

The host company must notify the Federal Office for Migration and Refugees (BAMF) of your stay beforehand. The BAMF will issue a certificate of entitlement to enter and stay within the framework of EU mobility.

  • You must hold a valid residence permit with the designation ICT issued by an EU member state.
  • You must intend to make an internal transfer to a German branch of a company.
  • You must be able to present a valid copy of your passport or a passport replacement document.

  • Required Documents

    Ihr Unternehmen, bei dem Sie erwerbstätig sind, muss die folgenden Nachweise in Kopie einreichen:

    • Aufenthaltstitel mit der Bezeichnung "ICT" des ersten EU-Mitgliedstaates,
    • Nachweis, dass die Niederlassung in Deutschland zum gleichen Unternehmen beziehungsweise zur gleichen Unternehmensgruppe gehört wie das Unternehmen im Drittstaat, bei dem Sie beschäftigt sind,
    • Arbeitsvertrag und eventuell Abordnungsschreiben,
    • anerkannter, gültiger Pass oder Passersatz,
    • Berufsausübungserlaubnis (wenn nötig).

    Hinweis: Sämtliche Dokumente, bis auf den Pass und den Aufenthaltstitel, müssen auf Deutsch eingereicht werden. Das BAMF kann gegebenenfalls leicht verständliche, fremdsprachige Dokumente akzeptieren, entscheidet jedoch, ob die eingereichten Unterlagen den Anforderungen genügen.

The host company in Germany must inform the BAMF of your stay before you enter the country. The notification may only be made by the company. The company can submit the notification online.

Online notification:

  • The online notification is made via the BAMF's specialist application MoNa (Mobility National Contact Points).
  • To access MoNa, the MoNa terms of use must be signed and sent to the BAMF. The company then receives a registration code for participation in the Delegated User Administration (DeBeV) for the administration of its employees for access to MoNa and the corresponding instructions for use. After successful DeBeV registration, the MoNa specialist application can be used.
  • The company notifies the entry and uploads all required documents.
  • Once the complete notification has been received, the BAMF checks whether all requirements have been met.
  • If the check is positive, the BAMF issues a mobility certificate.
  • The BAMF then informs the responsible immigration authority of the result.

There are no costs.

The notification must be made as soon as the intention of an intra-company transfer to a branch in the federal territory is known and must be received in full before the transferred employee enters the federal territory. If mobility is not refused within 20 days of receipt of the complete notification, the Federal Office will issue a certificate of authorization to enter and stay for the purpose of the intra-company transfer.
