Offer for children in secondary and special schools to receive a school medical examination by the health authorities of the districts and independent cities.
Children in secondary schools and special schools should be offered at least one medical examination by the health authorities of the districts and independent cities in order to identify physical, psychomotor, emotional and social impairments and, if necessary, to identify ways to remedy or alleviate them.
The aim is to initiate a medical or remedial educational measure if necessary.
If, for organizational reasons, no examination is offered, but such an examination is requested by the school or the parents/guardians, the parents/guardians and/or the school management can submit an application for an examination to the responsible health authority.
If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.
Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
The special school is attended by children and young people with special educational needs that cannot be met by other schools. They must be registered at the special school.
Legal guardians and school management can request a school medical consultation from the public health department if problems are identified in pupils that could be health-related or could lead to health impairments.
