With the establishment of a primary or secondary school for the area of several municipalities or parts thereof (association school), a school association is created from the participating municipalities, unless a regulation has been made in accordance with Art. 8 Para. 3 of the Bavarian School Financing Act (BaySchFG) or the responsibility for expenses has been transferred to a special-purpose association in accordance with Art. 17 Para. 1 of the Act on Municipal Cooperation (KommZG).
The school association is a public corporation and has the right to be the employer of civil servants. It is responsible for the school expenses for the association school.
A school association is created by law. The prerequisite for this is an ordinance issued by the government in accordance with Art. 26 BayEUG, in which a school district is defined for a primary or secondary school that extends beyond the area of a municipality. The school association expires with the dissolution of the association school.
Otherwise, Art. 9 BaySchFG largely refers to the special-purpose association law.
