The Bundestag election takes place every four years.
All Germans within the meaning of Art. 116 Para. 1 of the Basic Law who are at least 18 years old on election day and have been resident or ordinarily resident in Germany for at least three months and are not excluded from the right to vote as a result of a court ruling are eligible to vote. Germans domiciled or resident outside Germany are also entitled to vote under certain conditions.
Every voter has two votes: the first vote for the election of a constituency candidate and the second vote for the election of a party's state list. According to the Federal Elections Act, which will be amended in 2023, the 630 seats in the Bundestag will initially be allocated to the parties and their state lists: Each party receives the number of seats to which it is entitled according to the nationwide second vote result. These seats are then allocated to the state lists of the respective party based on their respective shares of the nationwide second vote result. The order of the seats to be filled for these seat quotas is then determined: The successful constituency candidates, i.e. those with the most first votes in their constituency, are considered first in the allocation of seats. If the party's state list is then entitled to further seats, these are allocated to the list candidates according to their order. If the number of successful constituency candidates on a Land list exceeds the number of seats covered by their second votes, the constituency candidates with the lowest share of first votes are not allocated a seat (second vote cover procedure). Parties that receive less than 5% of the second votes are not considered in the allocation of seats unless their candidates have received the most first votes in at least three constituencies.
Each political party can submit an election proposal (state list or district election proposal). District election nominations (at constituency level) may also be submitted by individual voters or groups of voters.
The municipal authorities keep a list of eligible voters for each electoral district.
The first mayor and members of the municipal council are generally elected for 6 years. Depending on the size of the municipality, 8 to 80 municipal council members are elected.
The Bavarian State Parliament and the district assemblies are elected for a term of five years.
As honorary members of the electoral and postal ballot boards, electoral assistants are responsible for the proper conduct of elections and votes and for determining and establishing the results.
