The Free State of Bavaria promotes the creation of permanent jobs subject to social insurance contributions for people with severe disabilities or equivalent status as well as the cooperation and joint employment of people with and without disabilities.

Inclusive companies offer severely disabled people and people with equivalent status whose participation in other employment on the general labor market encounters particular difficulties due to the nature and severity of their disability or other circumstances, diverse and adequate employment opportunities.
The aim is to create permanent jobs subject to social insurance contributions for people with severe disabilities or equivalent status as well as the cooperation and joint employment of people with and without disabilities. In Bavaria, inclusive companies are predominantly small or medium-sized companies from various sectors of the economy.
Inclusion companies differ from workshops for people with disabilities in that training and employment contracts are concluded with the persons concerned, with all the resulting rights and obligations under labor law, collective bargaining law and social law, and thus an employment relationship exists on the general labor market.
The Inclusion Office at the Bavarian Centre for Family and Social Affairs (ZBFS) can support the establishment, expansion, modernization and equipping of an inclusive business, including business consulting and special expenses, with funds from the equalization levy in accordance with SGB IX. Funding in Bavaria is provided in accordance with the "Guidelines for the funding of integration projects".
In addition, the needs of individual employees with severe disabilities can also be taken into account as part of individual case-related support in working life. Integration grants from the employment agencies in accordance with the Third Book of the German Social Code are also possible.
The inclusive company for which the benefit is applied for must
As a rule, the proportion of severely disabled people should not exceed 50 percent.
For construction measures additionally
The application must be submitted in writing or electronically to the locally responsible Inclusion Office.
In order to check responsibility, the ZBFS may also contact rehabilitation providers, such as the Employment Agency or the German Pension Insurance, in the case of benefits for special expenses.
Other bodies outside the ZBFS, e.g. the specialist integration service, may also be commissioned to prepare a statement or expert opinion.
If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.
Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
