Work placements serve to deepen knowledge of operational procedures, structures and processes and are intended to provide teachers with insights into the constantly evolving world of work.
Proof of a company internship is a prerequisite for the transfer of an office with a higher basic salary and for the transfer of a function at state vocational schools. Full-time, civil servant or permanent teachers at state vocational schools and at the State Institute for the Training of Specialist Teachers (Department IV), including employees of the ministerial commissioners and specialist employees of the governments and ministerial commissioners, are obliged to complete the internship. A work placement is expressly recommended for principals, heads of seminars, school supervisory officials and teachers seconded to other state authorities with non-teaching duties whose main school is a state vocational school.
The duration of a company internship is at least eight full working days in accordance with the respective company organization, which should be completed as consecutively as possible. In accordance with the letter from the Ministry of Education and Cultural Affairs dated 09/09/2019 on the implementation of the work placement for teachers at state vocational schools in Bavaria, part-time teachers can also complete the work placement part-time, which must extend to at least eight full working days for full-time teachers. In this case, the amount of time must at least correspond to the approved part-time extent, whereby teaching weeks are to be converted into hours. This means, for example, that for a part-time family policy of 14 teaching hours per week, the work placement must comprise approximately 23 hours. This amount is calculated on the assumption that 24 teaching hours per week correspond to a 40-hour week. The requirement of eight full working days does not apply to teachers working part-time for family policy reasons. Furthermore, the above-mentioned letter from the Ministry of Education stipulates that the teacher is to be granted a reduction of one hour per week of teaching time if the work placement is completed exclusively during non-teaching time. This reduction in teaching duties is not only granted for a work placement lasting eight (full) working days. In the case of teachers working part-time as part of a family policy, the time reduction of one hour per week per year must be granted if the work placement, which must correspond at least to the extent of the approved part-time period (i.e. in the example case at least 23 hours, see above), is completed entirely during non-teaching time.
If lessons can be ensured for the pupils, a work placement may also be completed during the teacher's teaching time. The decision is the responsibility of the head teacher.
The teacher is obliged to have a written confirmation of the completion of the internship or a corresponding activity countersigned by the internship company or the university or research institution; the submission of a formal internship contract or the submission of supplementary documents is not required either to the school management or to the school supervisory board.
Internships in companies of any legal form, authorities, institutions under public law, institutions of established religious communities or places of business of members of the liberal professions within the European Union, the states of the European Economic Area and Switzerland can be recognized. Until further notice, internships in the United Kingdom, in particular those that have already been agreed, can also be completed under the conditions applicable to European Union countries. In the case of internships in countries other than those mentioned, this must be brought to the attention of the head teacher in good time, who will decide on the appropriateness of the internship; internships at recognized development cooperation institutions and organized religious communities are generally considered appropriate.
Internships may not be completed in companies, public authorities, institutions, institutions of religious communities or members of the liberal professions in which the personnel or organizational responsibility for the teacher's specific area of work lies with a person who is a close relative of the teacher (Art. 20 para. 5 sentence 1 no. 1 - 4 Bavarian Administrative Procedure Act). The work placement may also take the form of an activity at a university or a recognized research institution that is equivalent in terms of time.
Activities that are carried out independently of the need to complete a work placement, e.g. as part of a continuous voluntary position, in a part-time job or a secondary position, are not recognized. Teaching, supervisory or administrative activities at a school or a domestic school supervisory authority are not recognized.
Teachers with a vocational specialization in social pedagogy and teachers who teach at vocational schools for child or social care, specialist academies for social pedagogy or at vocational secondary schools in the field of social work can complete their work placement at an independent non-profit organization or a municipality that acts as a cooperation partner for education and care services in open or tied all-day school programs.
The work placement or the corresponding activity serves the purpose of further training; the participants are accordingly granted protection against occupational accidents.
The Free State is not liable for damage caused intentionally by the participants during the work placement, nor is it liable for damage caused by negligence, provided that the corresponding risk is insured elsewhere or can be insured in a reasonable manner.
It is not possible to cover travel costs or other travel expenses. The company internship or the corresponding activity will be credited to the extent of a maximum of eight days towards the further training obligation in accordance with the announcements of the Ministry of Education and Cultural Affairs on teacher training in Bavaria dated August 9, 2002 (KWMBl. I p. 260), as amended. Provided that at least half of the work placement was completed during the teacher's non-teaching time, a reduction of 0.5 hours per week of compulsory teaching time is to be granted.
