Private special schools generally employ fully qualified teachers for this type of school. However, teachers from other types of schools and other special educational staff (e.g. remedial teachers, curative education nurses, educators) also work there.
The school supervisory approval of these teaching staff serves to determine and ensure the quality of teaching. Approval can be granted for a limited or unlimited period of time.
Privately employed nursing staff and private administrative staff at private special schools do not require school supervisory approval.
The school authority must submit a written application for school supervisory approval for each teacher to the government of the administrative district in which the private special school is located.
Applications are processed by the responsible government.
For teaching permits for use at secondary schools and technical colleges for special educational support, the school authority incurs costs for temporary and permanent school supervisory approval.
The application must be submitted in good time before the planned assignment of the teacher.
If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.
Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
The Free State of Bavaria grants subsidies to the providers of private special schools for the necessary school expenses as well as remuneration for the necessary personnel expenses. As an alternative to the reimbursement of staff costs, state teachers and other staff are assigned to them.
