If difficulties arise that could jeopardize the working or employment relationship with a severely disabled person, employers must involve the Inclusion Office at an early stage.
This form can be submitted electronically (e.g. via a secure contact form using your user account with login via the electronic ID function or the ELSTER certificate) or handwritten and signed in paper form to the responsible authority.
The prevention procedure is a measure to (permanently) secure the jobs of employees with severe disabilities and their equals. It is the employer's responsibility to implement it.
Employers are obliged to implement prevention in their companies and offices. This obligation applies to all employers, public and private, regardless of their employment obligation.
If personal, behavioral or operational difficulties arise in the employment or other employment relationship that could endanger this relationship, the employer must involve the representative body for severely disabled persons and the representative bodies named in Section 176 SGB IX as well as the Inclusion Office of the Bavarian Family and Social Affairs Center (ZBFS Inclusion Office) as early as possible in order to discuss with them all options and all available assistance for consultation and possible financial benefits with which the difficulties can be eliminated and the employment or other employment relationship can be continued as permanently as possible.
In the event of incapacity for work, the employer must take action if employees have been unable to work for six weeks within a twelve-month period. This applies to all employees of the company or department, regardless of whether they are severely disabled or not (for more information, see "Related topics").
The aim of the prevention procedure is to secure the job in the long term by eliminating or alleviating the difficulties that have arisen. All possible and reasonable assistance should be used.
Further information on the prevention procedure can be found on the website of the ZBFS Inclusion Office (see "Related links").
Employers must involve the representative body for severely disabled employees, the works council or staff council and the ZBFS Inclusion Office at an early stage if difficulties arise that could jeopardize the employment relationship with a severely disabled person.
If you are an employer carrying out a prevention procedure, send the completed contact form (see below) to the integration office responsible for you.
Here you can describe the difficulties you have encountered that could jeopardize your employment relationship. If necessary, enclose supporting documents (e.g. medical certificates, documents relating to an integration procedure that has been carried out).
The employer must involve the Inclusion Office if services from the Inclusion Office in the form of accompanying assistance are considered in the context of company integration management for severely disabled or equivalent persons.
