When implementing the law on the election of municipal councillors, mayors, district councils and county councillors, the legal supervisory authority examines the preparation and conduct of the elections as well as the election results determined by the election committee (Art. 50 Para. 1 GLKrWG).
The responsible legal supervisory authority for the election audit is the district administration office for municipalities belonging to the district and the government for municipalities and districts not belonging to the district.
If the legal supervisory authority establishes that election regulations have been violated and it is possible that this has resulted in an incorrect distribution of seats or offices, it may correct the election result. If a correction is not possible, it must declare the election invalid.
A municipal and district election can be contested with the legal supervisory authority due to a violation of electoral regulations.
