One of the requirements for the termination of residence is the existence of a valid travel document. The procurement of national passports and passport replacement documents is a highly demanding and very specialized task, for which native-speaking employees are sometimes called upon.

As soon as the obligation to leave the country is enforceable, the obligations to cooperate set out in Sections 48, 48a, 49 and 82 of the Act on the Residence, Employment and Integration of Foreigners in the Federal Territory (Residence Act - AufenthG) apply in full. The obligations to cooperate include all legal and factual acts that are necessary to obtain a missing identity document or to extend its validity and that can only be carried out personally by the person concerned.

If no valid travel documents are available, the Bavarian State Office for Asylum and Returns (LfAR), which is responsible for the procurement of home travel documents and contact with the diplomatic representations of other countries of origin throughout Bavaria, will immediately initiate the passport replacement document procedure ex officio once the obligation to leave the country is enforceable.

In coordination with other federal states and the Federal Police, the LfAR also organizes collective screenings at diplomatic missions or before experts of the suspected home country invited for this purpose in order to obtain home travel documents.

The costs incurred in obtaining a replacement passport must be borne by the foreign national concerned.
