The State Treaty on Gambling 2021 pursues the following objectives, among others:
In order to better achieve these objectives, the State Treaty prohibits the organization and brokering of public gambling without a permit.
Advertising for permitted gambling is permitted in compliance with the requirements of Section 5 GlüStV 2021, but the type and scope of advertising for public gambling must not run counter to the objectives of the Interstate Treaty on Gambling and the advertising must not be excessive. Advertising for unauthorized gambling is prohibited.
The gambling supervisory authorities have the task of monitoring compliance with the public law obligations associated with the Interstate Treaty on Gambling 2021 and working to ensure that the organization or brokering of unauthorized gambling and the advertising thereof does not take place. To this end, they can issue the necessary orders in individual cases within their area of responsibility.
The responsible gambling supervisory authorities in Bavaria are the municipalities, the district offices, the governments and the State Ministry of the Interior, Sport and Integration as security authorities.
The Joint Gambling Authority of the Federal States (GGL) is responsible for the supervision of gambling in relation to unauthorized public gambling and the advertising thereof, which is offered on the Internet in more than one state.

A permit is required under gambling law for the organization of so-called small lotteries and raffles or tombolas. Generally permitted events merely have to be reported.
If you want to organize commercial games with the possibility of winning (e.g. games of skill), you need a permit from the competent authority.
