An approved inspection body must notify the competent authority in the event of a dangerous or safety-relevant defect.
If the ZÜS detects a defect during the inspection of a system requiring monitoring that could endanger employees or other persons (dangerous defect), it must immediately notify the competent authority and send it the corresponding inspection certificate. In addition, the operator must be informed by the ZÜS that the system requiring monitoring may not be operated and must be labeled accordingly in a suitable manner. The ZÜS informs the operator that the system may not be put back into operation until it has determined in a follow-up inspection that the dangerous defect has been eliminated.
If the inspection of an installation requiring monitoring has revealed a defect that could pose a more than minor risk to the safety and health of employees and other persons if it is not remedied within a period of time specified by the ZÜS (safety-relevant defect), the ZÜS must inform the operator that the ZÜS must be commissioned to carry out a follow-up inspection within the period of time set by the ZÜS. The purpose of the inspection is to determine whether the defect has been rectified.
If the ZÜS has not been commissioned with the inspection within the period set by it in the case of a safety-relevant defect, it must notify the competent authority within 14 days of the expiry of this period.
The ZÜS must also notify the competent authority within 14 days if it has established during the inspection that a safety-relevant defect has not been rectified or has not been fully rectified.
The ZÜS identifies a dangerous defect during the inspection of a system requiring monitoring.
The ZÜS has not been commissioned by the operator to carry out the inspection to rectify a safety-relevant defect within the set deadline or the ZÜS has determined during the inspection to rectify a safety-relevant defect that the defect has not been rectified or has not been rectified in full.
The ZÜS informs the competent authority of the type, location and operator of the system requiring monitoring in question and sends the inspection certificate. This can be done via an online procedure, by e-mail, fax or in writing.
The notification to the authority enables it to take appropriate administrative action to counteract risks to health and safety.
In the event of dangerous defects, the ZÜS must notify the competent authority immediately.
In the event of safety-relevant defects, the ZÜS must notify the competent authority within 14 days if the ZÜS was not commissioned with the inspection in good time or if it is established during the inspection that the defect has not been rectified or has not been fully rectified.
