Description
All parties that have not already been continuously represented in the Bundestag or a Land parliament with at least five deputies since the last election on the basis of their own nominations must submit a notification of participation if they wish to take part in the election.
The notification must state the name under which the party wishes to participate in the election.
Requirements
The notification must be signed personally and by hand by at least three members of the Federal Executive Committee, including the Chairman or his deputy. If a party does not have a federal executive committee, the executive committee of the highest party organization shall take the place of the federal executive committee.

The Federal Returning Officer shall examine the notification of participation immediately upon receipt. If he identifies any deficiencies, he shall immediately notify the Executive Board and request it to rectify any deficiencies that can be remedied.

Participation in the election must be notified in writing to the Federal Returning Officer by 6 p.m. on the 97th day before the election at the latest.
Appeal
An appeal may be lodged with the Federal Constitutional Court within four days of notification against a determination that prevents a party or association from submitting nominations. In this case, the party or association shall be treated by the electoral bodies as a party entitled to submit nominations until a decision is made by the Federal Constitutional Court, at the latest until the end of the fifty-ninth day before the election.
