All parties that have not already been continuously represented in the Bundestag or a Land parliament with at least five deputies since the last election on the basis of their own nominations must submit a notification of participation if they wish to take part in the election.

The notification must state the name under which the party wishes to participate in the election.

The notification must be signed personally and by hand by at least three members of the Federal Executive Committee, including the Chairman or his deputy. An appeal may be lodged with the Federal Constitutional Court within four days of notification against a determination that prevents a party or association from submitting nominations.
