Non-compliant combustion engines can be reported by citizens, non-governmental organizations and other public bodies.
This form can be submitted electronically without signature (e.g. via a secure contact form or by e-mail) or in paper form to the responsible authority.
The aim of market surveillance is to ensure compliance with emission limits for combustion engines in mobile devices and machines and to protect against unfair competitive practices. This affects gardening equipment, DIY equipment, construction machinery, leisure equipment and special industrial machinery.
Immission control is affected, as the monitoring and control involves compliance with air pollutants such as unburned hydrocarbons, nitrogen oxides, soot and dust.
Compliance with the emission values of engines in mobile machinery and equipment is of fundamental importance. Non-compliant engines or the machines in which they are installed may not be placed on the market.
In addition to the active role of the authorities, the EU Market Surveillance Regulation and the national Market Surveillance Act also provide for the possibility of reporting non-compliant engines by citizens, non-governmental organizations and other public bodies. These can report their knowledge of suspected non-compliance to the body responsible for market surveillance. For the whole of Bavaria, this is the government of Lower Bavaria. There is no specific formal requirement for this notification.
The dealer and/or manufacturer of the appliance must be named and, if applicable, the emission problems associated with this appliance.
If there is a suspicion of non-compliance, the government of Lower Bavaria can be informed. It will then decide on the notification after examination.
