If you have submitted the building application or the notification of the start of construction online, the declaration of compliance with the catalog of criteria can be submitted directly online by the structural engineer.
The list of criteria includes various points that are relevant for checking the stability of the planned project. For certain projects, the structural engineer can declare that all the points listed in the catalog of criteria have been met. In this case, the otherwise necessary certification of the structural stability by a structural stability expert or the inspection of structural stability by the lower building supervisory authority, an inspection engineer or an inspection authority is not required. However, a declaration of compliance with the list of criteria must be submitted for this purpose.
The submission of the declaration of compliance with the criteria catalog is not an independent procedure, but must always be carried out in conjunction with other procedures. Depending on the respective building project, it must be submitted either as a building submission with the building application or as an annex to the notification of commencement of construction.
However, it can be submitted directly online by the structural engineer to accompany digitally submitted building applications and notifications of the start of construction.
If all the criteria in the list of criteria are met for buildings in building classes 1 to 3, containers, bridges, retaining walls, grandstands and other structures with a free height of more than 10 m that are not buildings, there is no need for a certificate of stability from a structural safety expert or a stability test by the lower building supervisory authority, a test engineer or a test office.
However, a declaration of compliance with the list of criteria issued by a qualified structural engineer, usually the author of the stability certificate, must be submitted for this purpose.
If the building project is a special building, the declaration must be submitted with the building application. Otherwise, submission with the notification of commencement of construction is sufficient.
Notwithstanding the above, the declaration does not have to be submitted for residential buildings in building classes 1 and 2 or single-storey buildings above ground with free spans of no more than 12 m and an area of no more than 1,600 m² that are not intended for the temporary residence of individual persons or only for temporary residence.
Digital submission of the declaration of compliance with the criteria catalog is not yet possible throughout Bavaria. When selecting a location, the link to the online procedure is displayed, if it is already offered.
In order to enable the lower building supervisory authority to assign the digital building application or the digital notification of the start of construction, it is necessary to provide the process number that was communicated to the submitter when the digital building application or the digital notification of the start of construction was submitted.

You must notify the start of construction in advance. This applies to the start of execution of projects requiring approval and the resumption of construction work after an interruption of more than 6 months.
