The reception, accommodation and distribution of asylum seekers is carried out in accordance with Sections 44 et seq. Asylum Act (AsylG) as well as the provisions of the Reception Act (AufnG) and the Asylum Implementation Ordinance (DVAsyl).

Foreigners who have to apply for asylum in accordance with Section 14 (1) AsylG are initially obliged to live in reception centers in accordance with Section 47 AsylG, Art. 2 (2) AufnG. In Bavaria, the existing reception facilities were converted into ANKERs on August 1, 2018.
Once the obligation to live in an ANKER has ended, the foreigners are distributed in accordance with §§ 50 f. AsylG, § 7 DVAsyl to the administrative districts as well as the administrative districts and independent municipalities in accordance with the quota in § 3 DVAsyl. The State Commissioner for the Reception and Distribution of Foreign Refugees and Aliens who have entered the country without authorization is responsible for the distribution to the administrative districts. Distribution to the administrative districts and independent municipalities is carried out by the respective government by means of an allocation decision. In addition to the household community of spouses and their underage unmarried children, other humanitarian reasons of equal weight as well as public safety and order concerns are also taken into account in the distribution and allocation.
After allocation to the administrative districts and independent municipalities, an intra-state redistribution or relocation request can be issued in accordance with the provisions of §§ 9, 10 DVAsyl. Cross-state redistribution to other federal states is carried out in accordance with § 51 AsylG, § 11 DVAsyl.
The Free State of Bavaria has created the Commissioner of the Free State of Bavaria for the Reception and Distribution of Foreign Refugees and Aliens who have entered the country without authorization (§ 2 DVAsyl) to carry out the internal distribution within the state in accordance with § 50 AsylG. The State Commissioner reports directly to the State Ministry of the Interior, Sport and Integration.
The Free State of Bavaria maintains reception facilities within the meaning of Section 44 of the Asylum Act (AsylG), which are set up and operated by the governments.
The Free State of Bavaria takes in ethnic German repatriates and Jewish emigrants assigned to Bavaria, distributes them and provides them with temporary accommodation.
