You can apply to the Bavarian State Office for the Protection of the Constitution (Bayerisches Landesamt für Verfassungsschutz - BayVSG) for information about the personal data that the State Office has stored about you in accordance with Art. 23 of the Bavarian Constitution Protection Act (BayVSG).
Upon request, the Bavarian State Office for the Protection of the Constitution (BayLfV) will provide information about the personal data it has stored about you. The prerequisite is that you demonstrate a "special interest" in the information. The information does not extend to the origin of the data and the recipients of transfers. Information will not be provided if one of the reasons for internal security listed in the law applies.
There are no rights to inspect files or other rights to information vis-à-vis the BayLfV. This applies, for example, to the rights to information under the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG), the right to access information under the Federal Freedom of Information Act (IFG) and the general right to information under Art. 39 of the Bavarian Data Protection Act (BayDSG).
If the BayLfV has stored data about you, you can request the correction of the data, the deletion of the data or the restriction of the processing of the data. Please state the reasons for the respective request.
You must demonstrate your "special interest" in receiving information.
Submit the request in writing (with your own signature) or via the secure contact form of the BayernPortal (log in with BayernID, e.g. with your new ID card or your ELSTER certificate, as the "substantial" or "high" level of trust is required) to the Bavarian State Office for the Protection of the Constitution.
Explain your "special interest" in receiving information.
Attach a legible copy or a legible scan of a current ID document to the application. The surname, first name, date of birth, place of birth, address and signature must be visible; other data, in particular access and serial numbers, can be blacked out.
A simple e-mail without proof of identity is not sufficient!
