The district administration offices are responsible for prosecuting misconduct by mayors of municipalities belonging to districts, while the governments are responsible for prosecuting misconduct by mayors of independent cities.
As an organ of the municipality, the mayor is subject to state supervision (legal and technical supervision).
As a civil servant, the mayor is subject to the provisions of disciplinary law. If there is reasonable suspicion of a breach of duty, disciplinary proceedings must be initiated against the mayor. This is generally carried out by the legal supervisory authority.
In the case of municipalities belonging to a district, the district administration office is therefore responsible as the lower state administrative authority; in the case of municipalities not belonging to a district, the government is responsible for examining whether there is sufficient suspicion of misconduct. However, they can also transfer their disciplinary powers to the Bavarian State Prosecutor's Office, which then acts in place of the legal supervisory authority.
