Procedure details

Further training institutions must apply for state recognition from the Association of Nurses in Bavaria (VdPB).

Subsequent significant changes to the relevant recognition requirements must be reported immediately. Otherwise, recognition may be withdrawn.

The state-recognized continuing education institutions are obliged to report to the competent authority on request on the facts relevant to the decision, to submit the necessary evidence and to cooperate in inspections.

If the VdPB has not decided on an application for state recognition within a period of four months after receipt of the application including the complete documentation, recognition is deemed to have been granted.

The competent authority for further training under the AVPfleWoqG is the VdPB (recognition is independent of location).

State recognition is granted upon application (Section 55 (2) AVPfleWoqG) if

  1. the management of the respective further training course has the appropriate professional and pedagogical qualifications,
  2. professionally and pedagogically suitable teaching staff are employed,
  3. a concept for the implementation of all modules is submitted and
  4. the further training is carried out in accordance with the provisions of the AVPfleWoqG.

  • Proof of qualifications
  • Proof of professional pedagogical aptitude
  • Proof of practical or teaching experience

Recognition is applied for online on the VdPB homepage.

A fee of EUR 400 to EUR 1,000 is charged for each training course (depending on the amount of work involved in the examination). The costs are calculated according to the Bavarian list of costs, tariff no. 7.VI.4/ no. 2.9 and 2.10.

Administrative court action
  • Appeal procedure (optional); lodging an appeal

If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
