Eligible teachers (including teachers whose personnel administration responsibility lies with the ministry) can apply to their local government for approval of the relocation allowance (= letter confirming that the settlement office may pay out the allowance amount).
The task of the government is to confirm the granting of the relocation allowance. The grant itself (financial settlement) is made by submitting a further application to the State Finance Office together with the letter of approval from the government.
The relocation expenses allowance must not be confused with the relocation expenses allowance pursuant to Art. 4 of the Bavarian Relocation Expenses Act, which is granted for relocations for official reasons. In the latter case, the actual or notional removal costs incurred are reimbursed, whereas the former is granted for welfare reasons.
The Free State of Bavaria grants the relocation allowance in cases where the move is necessary for family or health reasons because the current accommodation is inadequate or unsuitable. The relocation allowance currently amounts to a lump sum of EUR 600.00 and is increased by EUR 250.00 per eligible family member (see Art. 11 Para. 2 Bavarian Relocation Costs Act for the group of eligible persons).
In the cases of Art. 11 Para. 1 No. 1 of the Bavarian Relocation Costs Act (addition to the family), the government will check whether the previous home is inadequate due to the addition to the family and a move has therefore become necessary.
In the case of a move for health reasons, the necessity of the move must be proven by means of a medical certificate from a public health officer (Art. 11 Para. 1 No. 3 Bavarian Relocation Costs Act).
All civil servant teachers are eligible to apply. The provisions of the Bavarian Relocation Costs Act apply accordingly to employees on the basis of the collective agreement in Section 23 (4) of the Collective Agreement for the Public Service of the Federal States.
The granting of a relocation allowance on application is possible for relocations
The required documents must be submitted in full to the responsible government for approval of the relocation allowance. In addition, confirmation from the school management may be required.
The application can be submitted informally. The application can be submitted in writing (letter / fax) or by e-mail. If you submit the application by e-mail, the application must be sent in pdf format.
The VIVA personnel number must be stated.
In the case of a move for health reasons, the health necessity must be justified.
In exceptional cases where the deadline has expired, the responsible office of the State Office of Finance will be asked whether an application for the relocation allowance has been received in time.
If the relocation allowance is granted, the applicant will receive a written confirmation, a copy of which must then be submitted to the State Finance Office.
The approval of the relocation allowance itself is not time-bound, it can also be granted after the move, see Art. 3 para. 1 sentence 2 of the Bavarian Relocation Costs Act. However, no more than 6 months may have elapsed since the move (cut-off period) for the granting (i.e. payment) of the relocation allowance by the State Office of Finance upon receipt of the application, so that a commitment is no longer possible in these cases.
The allowance must be repaid if the beneficiary's employment ends within two years of the end of the relocation for a reason for which he/she is responsible, Art. 11 para. 3 sentence 1 of the Bavarian Relocation Costs Act.
