Procedure details

The provision of all-day education and childcare services and thus the expansion of all-day school services are among the key educational and socio-political challenges. In order to implement the pedagogical all-day concept, it is possible to employ individuals within the framework of the collective agreement for the public service of the federal states (TV-L) in addition to cooperation agreements with independent providers.

In consultation with the school (expense) provider and, if necessary, in agreement with the cooperation partner, the school management can also employ individuals for educational and support services in the open and tied all-day programs. For this purpose, an employment or service relationship between the individual and the Free State of Bavaria, represented by the relevant government, is established at state schools at the suggestion of the school management. The respective government is responsible for classification, recruitment and conclusion of the contract.

Approval of the pedagogical concept for the all-day school and the existence of the approval and funding requirements in accordance with the Minister of Education's announcement (KMBek) for the corresponding all-day school form.

  • For the conclusion of TV-L individual contracts in the bound or open all-day, the responsible government requires various documents at the time of initial employment (if forms are provided, you will find them under "Forms"):
    • Application to conclude an employment contract (to be completed by the school)

    • Declaration of the employee (on previous convictions, etc.)

    • Instruction in accordance with §§ 34, 35 Infection Protection Law
    • Agreement on fixed-term employment relationship (must be concluded before employment begins)
    • Consent of local personnel council before starting work
    • Notification of commencement of employment
    • Job description to determine the pay grade of employees in full-time schools and open all-day schools
    • Proof of periods of relevant previous employment (e.g. references)
    • Copy of identity card
    • Copy of social security card
    • If applicable, a copy of a severely handicapped person's ID or a notice of equality
    • Proof of completed professional training (copies of certificates)
    • Current extended certificate of good conduct according to § 30 a BZRG (document type OE)
    • Application for exemption from compulsory pension insurance, if applicable

    • Instruction on official duties and important regulations for employees
    • for persons born after 1970: Documentation aid from the school management for proof of sufficient measles protection in accordance with § 20 Para. 9 Infektionsschutzgesetz (IfSG); the start of employment can only take place when corresponding proof has been provided.

  • In the case of continued employment, the competent government requires the following documents (if forms are provided, you will find them under "Forms"):
    • Application to conclude an employment contract (to be completed by the school)

    • Application by employees covered by collective agreements (employment contract) for tax exemption of income from part-time work in accordance with § 3 No. 26 EStG (to be completed by the person to be hired)
    • Agreement on the fixed term of the employment relationship (must be concluded prior to commencement of employment)
    • Job description for determining the salary group of employees in full-time schools and open all-day schools
    • Agreement of the local staff council prior to commencement of employment

The documents must be sent to the government as soon as possible.

In consultation with the school (expense) provider, the school management can transfer the implementation of the education and care services in the open and tied all-day programs in whole or in part to an independent non-profit provider or a municipality as a cooperation partner. For this purpose, a cooperation agreement is concluded at state schools between the independent provider or the local authority and the Free State of Bavaria, represented by the relevant government, at the suggestion of the school management.
