Procedure details

All plant protection equipment in use for area or indoor crops must be tested at intervals of six calendar half-years.

The testing of plant protection equipment is carried out by officially recognized inspection bodies. The inspection body activities are usually carried out by agricultural machinery workshops.

The ÄELF with additional tasks in the field of plant cultivation are responsible for recognizing inspection bodies for plant protection equipment. They check with the applicant whether all the requirements necessary to be able to inspect plant protection equipment are met. If all requirements for recognition are met, they grant recognition as an inspection body for plant protection equipment.

Commercial companies are recognized as inspection bodies for carrying out inspections on plant protection equipment upon application if

  1. the company can guarantee that the inspections are carried out accurately and reliably
  2. the company employs a sufficient number of persons who are professionally qualified to inspect plant protection equipment
  3. the company has the necessary equipment for the inspection work at its disposal and
  4. the company ensures inspection readiness by mutual agreement with the competent authority.

The more detailed requirements are set out in Section 2 sentence 2 in conjunction with Annex 1 of the Ordinance on the Performance of Inspections of Plant Protection Equipment.

  • Proof of registration in the Handicrafts Register or of membership of the Chamber of Industry and Commerce
  • the name, address and photograph of the persons assigned to the control activity, proof of their professional training and successful participation in a training course
    A person is technically suitable if he has completed training in the agricultural machinery or blacksmith trade, e.g. as an agricultural machinery mechanic, has successfully taken part in a training course in which knowledge and skills about the technical plant protection requirements and about the function and setting of the plant protection equipment are imparted, has the necessary reliability and has at least one year's specialist work experience.
  • Details of the intended place of inspection
    Suitability includes, in particular, adequate protection against the effects of the weather
  • evidence of the availability of suitable collection and return facilities for the control liquid
  • Proof of the availability of the necessary control equipment
  • Evidence of the measurement accuracy of the test equipment

Fees of EUR 100 to EUR 500 are charged for recognition as an inspection body for plant protection equipment (List of Costs Tariff No. 6.II.3/7).

The procedure for recognition as an inspection body must be completed by the competent authority within three months of submission of the complete documentation. The deadline may be extended once by two months if this is justified due to the difficulty of the matter.

    If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

    Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
