The Bavarian State Ministry for Family, Labor and Social Affairs awards people who have rendered special services to people with disabilities in need of care through personal care or in other ways with a care medal and a certificate of thanks and honor in recognition of their social work.
People with disabilities who are in need of care are people who are so helpless that, as a result of their disability, they require a considerable amount of permanent assistance from others, not just temporarily, for the usual and regularly recurring tasks of daily life.
As a rule, proof is provided by the severely disabled person's pass with the H mark or by the notification of the granting of a care allowance or care allowance.
The disabled person in need of care must live in Bavaria.
Caregivers are caregivers who are close to the person with a disability in need of care, who provide care by way of neighborly help or who work on a voluntary basis as part of an outpatient social service.
The care must generally be provided at home and free of charge. A small fee or the reimbursement of expenses incurred by the caregiver does not preclude the award.
The caregiver must be worthy of the honor in terms of reputation and standing, i.e. the person must not have an unrestricted entry in the Federal Central Criminal Register due to a final conviction.
In principle, care should include all services required for care and support. Comprehensive care in this sense also includes, for example, any additional special supervision required by a person with a disability as well as the management of their household and the care of their children.
The care must have been provided regularly and generally over a continuous period of at least five years. Shorter interruptions in care, e.g. due to vacation or illness of the caregiver or the person with a disability in need of care, do not exclude the award.
Persons who have rendered outstanding services to people with disabilities in need of care in ways other than personal care may also be honored.
Welfare and disability associations, social service providers, providers of facilities and services for the disabled, local authorities and any citizen are entitled to make nominations. The nomination for the award must be submitted to the municipality in which the person to be honored lives (municipality of residence). Nomination forms are available from all municipalities, district offices and governments.
In the case of proposals from welfare and disability associations, social service providers, providers of facilities and services for the disabled and local authorities, the municipality of residence confirms that it has no information that would prevent the honor being awarded. In the case of proposals from individual citizens, the municipality of residence confirms that the requirements for the award have been met or explains why it does not consider the requirements to have been met.
The municipality forwards the reviewed proposal with its confirmation to the responsible government (in the case of municipalities belonging to a district, via the district administration office).
The responsible government forwards the proposal to the Bavarian State Ministry for Family, Labor and Social Affairs with its opinion for a decision and the latter prepares the issuing of the certificate of thanks and honor.
The certificate of thanks and honor is signed by the Minister of State for Family, Labor and Social Affairs. The nursing medal and the certificate of thanks and honor are presented by the Minister of State, by one of his or her representatives or, by special arrangement, by another person, e.g. the mayor of the municipality of residence.
The proposal to honor the caregiver should be received by the municipality of residence no later than one year after the death of the person with disabilities who was cared for.
